Welcome to HomeHeading.

HomeHeading provides software tools and digital experiences that help consumers submit real estate-related preferences and contact information, and help real estate professionals collect, organize, respond to, and manage inbound inquiries and related data.

By accessing or using the platform, you agree to these Terms of Service.

HomeHeading provides:

• guided intake experiences for buyers and sellers
• lead capture, routing, and communication tools
• branded landing pages and related software tools for participating professionals
• analytics, workflow, and database-connected platform features

HomeHeading does not:

• provide real estate brokerage services
• represent buyers or sellers in a transaction
• guarantee property availability, pricing, or transaction outcomes
• act as a law firm, title company, lender, appraiser, or inspector

Any real estate services are performed by independent licensed professionals, not by HomeHeading unless expressly stated otherwise.

If you create or use an account on the platform, you are responsible for:

• maintaining accurate account information
• protecting your login credentials
• all activity occurring under your account

You may not use the platform for unlawful, misleading, fraudulent, or abusive purposes.

By submitting information through the platform, you represent that the information you provide is accurate to the best of your knowledge.

You understand and agree that:

• your information may be stored in HomeHeading's platform and central database systems
• your information may be shared with one or more licensed real estate professionals or their authorized team members for the purpose of responding to your inquiry and providing related services
• those professionals may contact you using the contact methods you provide

Submitting information through the platform constitutes a request to be contacted regarding the services you selected or requested.

Use of the platform does not itself create:

• an agency relationship
• a client relationship
• a brokerage agreement
• any fiduciary duty

Any such relationship must be established separately, if at all, with an appropriate licensed professional.

HomeHeading and its licensors own the platform software, design, layout, structure, and related intellectual property, except for content provided by users or customers.

If you submit, upload, publish, connect, or otherwise make available content, branding assets, copy, images, logos, page designs, testimonials, reviews, or other materials through the platform (“Customer Content”), you retain your ownership of that content, but you grant HomeHeading a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, modify for formatting, and distribute that content as reasonably necessary to operate, support, improve, and promote the platform.

You also grant HomeHeading permission to use non-confidential Customer Content, platform page screenshots, workflow screenshots, account-level visual examples, and related materials for:

• marketing and promotional materials
• product demonstrations
• case studies
• investor, partner, or sales presentations
• website and social media examples

HomeHeading will not intentionally use confidential transaction details, private consumer information, or sensitive personal information in public-facing marketing materials without additional permission.

If you want HomeHeading not to use specific materials for promotional purposes, that restriction must be agreed to separately in writing.

You acknowledge and agree that HomeHeading may collect, store, analyze, and use data from platform activity, connected databases, submitted forms, page usage, workflow actions, and related operational records to:

• operate and support the platform
• improve product performance and usability
• monitor security, abuse, and fraud
• generate internal analytics, reporting, and business insights
• develop aggregated, de-identified, or anonymized product intelligence

HomeHeading will handle personal information in accordance with its Privacy Policy.

You agree not to:

• submit false or misleading information
• violate any law or third-party rights
• interfere with or disrupt the platform
• attempt unauthorized access
• use the platform for spam, scraping, abuse, or harmful automation

HomeHeading makes no guarantee regarding:

• platform uptime
• response times from independent professionals
• property availability or pricing
• transaction outcomes
• business results from use of the platform

To the fullest extent permitted by law, HomeHeading is not liable for indirect, incidental, consequential, special, or punitive damages, or for losses arising from:

• use of or inability to use the platform
• actions or omissions of independent professionals
• data loss, interruption, or unauthorized access beyond HomeHeading's reasonable control

These Terms may be updated from time to time. Continued use of the platform after an update constitutes acceptance of the revised Terms.
